Penpa Tsering takes Kashag to court, says grounds for his termination manipulative
DHARAMSALA, May 18: Penpa Tsering has filed a case in the exile Tibetan Supreme Justice Commission challenging the reasons cited by Kashag (Tibetan Cabinet) for his termination from the Office of Tibet in Washington, Central Tibetan Administration’s (CTA) mission in North America.
Former Tibetan Representative of North America, Penpa Tsering said that the grounds CTA President Lobsang Sangay led 15th Kashag’s cited for his termination from its mission in North America are false accusations and manipulative as he filed the case today in the exile Tibetan Supreme Justice Commission located here at the Central Tibetan Secretariat in Gangchen Kyishong.
Penpa Tsering said he approached the Tibetan Supreme Justice Commission claiming Kashag’s allegations are untrue, incomplete and manipulative.
However, the Kashag who has the prerogative to terminate the services of its representatives says Penpa Tsering was terminated from the office as per Chapter 1 Article 1(3) of the Tibetan Charter and Article 19(1) of the Tibetan Public Service Commission rules and regulations according to a circular issued on Nov 7, 2017.
The Kashag further issued a 10-point clarification on its decision and cited growing trust deficit, underperformance and insubordination as key reasons to replace Penpa Tsering after the public outrage over the matter.
Penpa Tsering though accepted Kashag’s decision to terminate him from the office, he refuted all allegations levelled against him by the Kashag at a press conference held here in Mcleod Ganj on December 5, 2018.
Later, CTA President Sangay in his address at an official function suggested that knocking the door of the court is the only way to settle the matter and said only the court can decide whether the Kashag has violated its power over the ousting of CTA’s North America mission as he stood by his cabinet’s decision.
Though it remains to be seen whether the Tibetan Supreme Justice Commission will accept Penpa Tsering’s case or not, he believes that knocking the door of the court is the only way to settle the matter now and said he did so by shouldering the responsibility as a Tibetan citizen else it can’t be predicted what will happen in the future.
“I approached the court because I am not at fault. Though I can’t say what will be the verdict of the court, we Tibetans should accept the court’s verdict,” Penpa Tsering said.
